HOLYOKE, Colo. — An accused person who told a Phillips County judge he lacked transportation to travel to another city to apply for a public defender was warned Wednesday that he could lose access to court-appointed counsel if he failed to complete the application, highlighting the barriers rural and low-income defendants can face in securing legal representation.
During the session, Judge Kimbra Killin called a compliance hearing for the accused, who appeared with the assistance of a Spanish interpreter. The court previously instructed the accused to travel to Sterling to complete an application for a court-appointed public defender.
When asked why the paperwork had not been submitted, the accused explained to the court that he had no way to drive to Sterling to complete the application process.
Rather than accommodating the logistical hardship, Killin rejected the explanation, noting that the court originally granted a one-week deadline and that one month had passed. Killin warned the accused that if he failed to submit the application, he would not receive a court-appointed attorney.
Following the exchange, the court formally filed a violation of bond against the accused and scheduled the next court appearance for Sept. 7.
Requiring defendants in rural jurisdictions to travel long distances without reliable public transit severely penalizes vulnerable community members. When courts treat physical travel limitations as willful noncompliance, defendants face the immediate threat of losing their constitutional right to counsel and risking bond revocation simply because of a lack of transportation.
