Day #3 Update – Davis/Yolo Team Cap-to-Cap Trip

April 12, 2012 (Washington DC) – Another full day of meetings with elected officials and agencies by the Davis/Yolo Team today. It has been a very long day, but let me tell you some highlights and I will expand on them tomorrow when I am fresh.

We started the day with a legislative briefing at Nossaman, LLP, near our hotel.  From there we went to meet with Congressman John Garamendi.  Mr. Garamendi was gracious enough to give us extra time, even though he had other meetings planned very close to ours.

Weist Dishonestly Claims Union Front-Group, Citizen-Based

When the group, Friends of Davis Firefighters sent out a press release this week, announcing that a new organization has been launched to defend the Davis firefighters and claiming, “A group of prominent Davis citizens today announced the formation of a new community group, the Friends of Davis Firefighters, to educate the community about the ongoing efforts of the Davis Fire Department to ensure the safety of the City of Davis’ 69,000 residents through its emergency and preventive services,” it was not hard to figure out the origins of the group.

After all the group’s domain name was registered to Bobby Weist, the union present and the PO Box referred to the union’s PO Box.

Defense Attorneys File Appeal Challenging Gang Injunction Ruling

gang-stock-picIn March of 2011, Judge Kathleen White, following a nearly six-month trial that went from July 12, 2010 to December 15, 2010 on alternate weeks, issued her ruling in favor of upholding the gang injunction in West Sacramento.  Three months later, she issued a final “Judgment Granting Injunction After Trial” against the Broderick Boys criminal street gang in West Sacramento.

The gang injunction issued by the court imposed a curfew and restricted other activities of gang members in a defined area within West Sacramento called the “Safety Zone.”

April 11, 2013 (Washington DC) – Today the Davis/Yolo Team spent a full day meeting with representatives from elected officials’ offices, to agencies throughout the DC area.

We were delighted to find out during our meetings today that we have arrived in DC at the peak of Cherry Blossoms Season. Several staffers in our meetings gave us the story about the cherry blossom trees in DC, and that they came from Japan during the President Grant Administration.  For an interesting story about this, search “Cherry Blossom President Grant.”

VANGUARD COURT WATCH: Defendant Makes Court Appearance in Wheelchair – Accused of Resisting Arrest

Today in Judge Fall’s courtroom, Marlon Raye was brought from jail in a wheelchair for a probable cause hearing. He was arrested in West Sacramento on February 19 while riding a bicycle. He was charged with Resisting/Delaying Arrest and Possession of Methamphetamine.

Officer Wright, of the West Sacramento Police Department, testified that he observed the bicycle leaving the Pickwick Motel shortly after midnight. The officer was patrolling on foot. He called for assistance. No mention was made of why Officer Wright believed there was a reason to pursue Mr. Raye, nor why he was not in a patrol car. Foot patrol is not a common method used in West Sacramento.

Wednesday was a travel day as the Davis Team arrived in Washington, DC.  Davis CIO Rob White described the trip as “tiring” and reported, “the team spent much of their respective plane rides strategizing and discussing the objectives of the trip.”

He remarked that the team traveled from Sacramento through Denver where the temperature was a brisk 7 degrees and landed in Washington, DC where it was a sweltering 90 degrees.  “An amazing swing in temperatures as we flew across the country.”

Commentary: Public Disengaged on the Budget Process

Participatory_BudgetingShould the City Pursue Participatory Budgeting? – On Tuesday night, Councilmember Lucas Frerichs noted, as the council began to ponder almost overwhelming and insurmountable budget challenges, the utter lack of public participation in the process at this point.

Councilmember Frerichs noted that he was interested in pursuing participatory budgeting.  He said that he is glad that the budget process was being engaged earlier in the cycle than it was last year when the council got the budget in June and had to act quickly to pass it before the end of the month.

Progress Made on State and Federal Gun Control

gun-controlDemocrats in Washington believe they have the 60 votes they need to proceed to a debate on gun control legislation, after a number of Republicans agreed not to support a filibuster following a deal on background checks for gun purchases being announced on Wednesday by Republican Senator Pat Toomey (Pennsylvania) and Democrat Joe Manchin (West Virginia).

According to The Hill, “The proposal would expand background checks to cover all sales at gun shows and over the Internet. Those background checks would have to be accompanied by records proving to law enforcement officials they took place.”

VANGUARD COURT WATCH: Crimes Across Counties Problematic in Assuring Right to a Fair Trial

On the morning of Monday, April 8, 2013, in Department 3 of the Superior Court of California, Yolo County, the armed robbery case of Andrew White was set to start under the Honorable Stephen L. Mock.

Andrew White is charged with two counts of robbery with use of a firearm, with an additional two enhancements related to discharging a firearm that inflicted great bodily injury.

Council Meets Roads “Crisis” Head On

The PowerPoint slide said that the city’s street PCI (Pavement Condition Index) was “nearing danger level.”  City Manager Pinkerton did not shirk from that description, saying that the pavement index was “reaching crisis level.”

Neither did interim Public Works Director Bob Clarke minimize the situation, calling it “a significant challenge” and saying we need to find a “reasonable balance of pavement maintenance that we have a reasonable chance of funding.”

innovation-technologyCity to Display Commitment to Economic and High Tech Development – The City of Davis signaled that it was serious in its efforts to develop a high-tech and university research spin-off base, by partnering with techDavis to bring in Rob White as the city’s first Chief Innovation Officer.

Now the city wishes to put these assets to work this week, as representatives from the City of Davis, Davis Chamber of Commerce, techDAVIS, UC Davis, Yolo County, and the Davis business community will be spending time in Washington, DC, starting Wed, April 10 through Wed, April 17.  This trip is planned as part of the annual Sacramento Metro Chamber’s Capitol to Capitol trip that occurs each April.

City Names Mike Webb New Planning Director

city-hallLast week, we learned that Ken Hiatt, the Community Development and Sustainability Director for the city of Davis, is leaving his city position effective April 26, to take a similar job with the city of Woodland.

On Tuesday, the city of Davis wasted little time finding a replacement – a familiar face, Mike Webb.  His position will take effect on May 20, 2013.

Union Fights Back, Launches Organization to Defend Davis Firefighters

When the Davis City Council delayed the decision to go forward with fire staffing changes recommended by former interim Chief Scott Kenley, several members both publicly and in private suggested that putting the fire issue into the broader budgetary context would be the way to go.

While the newly-presented budget, agendized for tonight at the city council meeting, turns up the heat, assuming the savings from both fire staffing changes as well as concessions during the collective bargaining process, the fear has been that giving the firefighters another three to four months to organize would be a huge risk.

Eye on the Courts: Groundbreaking Grand New Courthouse Masks the Reality of Injustice

yolo_county_courthouseJudge David Rosenberg has been working on this new courthouse for a decade now, and he deserves tremendous credit for the fortitude and skill to get it to the point where on Friday they actually broke ground on the new building.

“We truly love our historic courthouse … but it was built five generations ago for another time and another era,” he said, as quoted in other news accounts.  “We have outgrown that historic courthouse in every conceivable way.”

VANGUARD COURT WATCH: Yolo County Gang Case Getting Set For Trial

On Friday March 29, 2013, eleven alleged gang members, with all of nine different defense attorneys, filed into the courtroom. Nine different defense attorneys, with a couple conflict attorneys in that pile, were sent to the judge’s chambers for what seemed like forever, only to come out with yet another continuance date.

Some of the defendants were out of custody. Their charges stem from possession of drugs to possessing firearms and other gang-related activity. The People’s case is represented by Robin Johnson, Deputy District Attorney.

Past Councils Failed to Invest in Roads, Other Critical Infrastructure

The city faces a monumental task of figuring out how to deal with an impending road pavement crisis, within the current limitations of the budget.  In addition to a discussion of the budget this week, the council will receive a presentation, along with an action plan, on pavement management.

The current budget only calls for $2.3 million to put toward street maintenance, and $1 million of that is the money budgeted from last year that was carried over from last year.

Commentary: The Gay Agenda

gay-marriage-badgeIt seems a number of people, in arguing against marriage equality, believe there is a broader agenda at work here.  Leaving aside the untenable logic of the claim that you might oppose a reasonable reform because you fear the next reform will be less than reasonable, I think marriage equality has taken on a symbolic importance in the broader movement toward civil rights for all.

While I believe marriage equality is an important step, as it begins to equalize critical institutions, and gives same-sex partnerships the same legal status of protection that others enjoy, at the same time I believe it might not even be the most important of changes still to be achieved.

Dolores Huerta to Speak at Freeborn Hall

Chavez-113th Annual Cesar E. Chavez Youth Leadership Conference at UC Davis on April 13

UC Davis, CA – Close to 500 middle and high school students will converge on the UC Davis campus for the 13th Annual Cesar E. Chavez Youth Leadership Conference and Celebration on Saturday, April 13, 2013 in Freeborn Hall and Wellman Hall.

The conference will include an Arts, Education, Health and Job Fair.  For over a decade, this event has provided guidance to youth seeking to pursue higher education and grant information.  Dolores Huerta will speak around 12:45pm in Freeborn Hall.

Sunday Commentary: Just When You Thought It Was Safe…

A reader made the flippant remark that at least we’re not Stockton, and as Stockton continues to struggle with bankruptcy and getting themselves out of debt and obligations, we are quite fortunate.  But for most places this side of Stockton, the news coming out this week is not good.

Somehow, approaching the five-year mark of the collapse of Lehman Brothers, the city of Davis is still churning a not-so-insignificant $2 million deficit, which represents about 4.7 percent of the budget.

Commentary: On a Personal Note

cobain-kurtI was a college freshman when a guy who lived down the hall in our dorm walked into our room, plopped a CD into my roommate’s disc player and blasted a track from a new and unknown band called Nirvana.  I was blown away by it.  I had never heard anything like that before.

“Smells Like Teen Spirit,” exploded a few weeks later, fueled by MTV and capturing the spirit of the times and, some might say, the spirit of a generation.  The lyrics are almost intelligible and once you translate them, they turn out to be unintelligible with hooks like “I feel stupid and contagious, here we are now, entertain us.”
