COURT WATCH: Judge Discusses Possible Bond after Accused Misses Court Appearance

NEWPORT BEACH, Calif. — During a Thursday hearing at the Harbor Justice Center, Judge Richard E. Pacheco considered a public defender’s request to hold a bench warrant after the accused failed to appear in court for reasons that remained unknown.

The public defender told the court that he had attempted to contact the accused but had been unsuccessful, stating that he “left him voicemails and gave him a text.”

The attorney also explained that the accused had attempted to attend a previous hearing but ultimately did not appear. The reason for the accused’s absence at Thursday’s hearing was unknown.

Because the public defender had been unable to reach the accused, he requested that the court hold off on issuing a bench warrant.

In response, Judge Pacheco discussed possible explanations for the missed appearance, indicating that even circumstances involving employment obligations or a car accident could result in the accused being required to post bond.

Pacheco stated that if “he got called into work, he’s getting a bond” or if “he called and he got in a car accident, he’s getting a bond.”

Following the judge’s comments, the public defender requested that several attorneys meet in chambers to discuss the case further.
