ACLU Calls on Alameda School District to Lift Black Lives Matter Ban

Censorship Violates First Amendment and California Constitution

(From Press Release) – The ACLU of Northern California today sent a letter to the superintendent of the Alameda Unified School District urging him to reconsider a ban on Black Lives Matter signs and stickers.

The ban violates the California constitution by placing unlawful restrictions on student speech and conduct, as well as the First Amendment.

“Black Lives Matter stickers and signs are protected speech and censorship of them is illegal,” said ACLU of Northern California staff attorney Abre’ Conner.

Dede Lewis, a parent in the district, learned of the ban from another parent after school officials removed Black Lives Matter signs from a common area at Maya Lin Elementary School. They also told
students that Black Lives Matter signs would not be allowed on campus moving forward unless it was part of student artwork. Read Dede’s account of the incident.

Lewis contacted Superintendent Sean McPhetridge, who confirmed the ban and cited a school board policy that says “the superintendent, principal, or designee shall not accept for distribution any materials or advertisements that…proselytize or position the district on any side of a controversial issue.”

McPhetridge said the issue was brought to his attention by a parent whose child had picked up a Black Lives Matter sticker from a table at school. The family “did not appreciate and did not solicit” the sticker.

The superintendent went on to say that if the district allowed Black Lives Matter stickers and signs, it would also have to allow the “opposite viewpoint” and let students bring “White Lives Matter” stickers and signs.

“This is a false equivalency because there are no systems in place that have been marginalizing white folks for generations,” said Lewis. “Saying Black Lives Matter does not imply anything about any other lives. It is simply acknowledging that Black Lives Matter, too.”

Lewis was one of a number of parents who expressed concern after a four-foot long noose was found hanging from a fence at Alameda High School on September 5. Following that, there were ongoing debates about police violence and racism. Many students wore Black Lives Matter stickers and brought signs to show support.

On Sept. 6, a “Black Lives Matter” sign at Maya Lin Elementary was vandalized and changed to “All Lives Matter.” That evening at back to school night, stickers and signs were placed in the common area at the school to show support for Black students. That’s when the school district received the parent complaint.

“It’s sad that the Alameda district considers discussions regarding supporting Black lives, fixing police brutality, and ending racism controversial,” Conner said. “School districts do not have a right to violate protected speech based on arbitrary reasons.

Legally, students have a right to free speech and expression at school. They have the right to wear sports jerseys, shirts that show solidarity with LGBTQ students, and they have a right to support the Black Lives Matter movement.

The letter seeks a response from the district by November 13. If the problem isn’t rectified, the ACLU will consider next steps.

  1.  “Black Lives Matter” sign at Maya Lin Elementary was vandalized and changed to “All Lives Matter.” 

    Someone changed the sign… it is characterized as ‘vandalism’… is it not “free speech”?  Given the sign was unauthorized on public property?

    Is the concept of ‘all lives matter’ a public threat?

      1. You compare ‘authorized’ (your word) to ‘unauthorized’… assume that was a typo…

        If someone places a noose on a tree in a public park, claiming it is art, is its removal by a private citizen ‘vandalism’?  A noose is very different from a sign, granted.  There is more than 50 shades of gray.

        What if someone added “God says,” to ‘Black lives matter’, and school officials removed the sign due to church/state fears, who commits vandalism?

        The article has a slant… it shows up in adjectives used…

        What if the stickers said “Make America Great Again”?  Innocuous in the words themselves, but would bet that folk would go ballistic… at least 95 shades of gray.

        Black lives matter… we need to make America great by getting past racism, etc., and live up to our ideals.

  2. When should we expect parts 3 & 4 of this media outreach on Alameda, by the ACLU?

    To say that parts 1 & 2 were not part of a ‘campaign’ would appear to be disingenuous…

    I agree with Ms. Lewis on the false equivalency; but that’s not the issue. To allow a Black Lives Matter sign but disallow an All Lives Matter sign would impose a content-based standard on allowable speech in violation of the First Amendment. Even wrong-headed speech is protected. The superintendent is correct here. Whether the practice of posting signs or handing out stickers should be banned altogether is a separate discussion.

  4. The ACLU really seems have lost their way. In addition to Eric’s point “Education Code Section 220 prohibits discrimination on the basis of disability, gender, gender identity, gender expression, nationality, race or ethnicity, religion, sexual orientation, or any other characteristic that is contained in the definition of hate crimes as described in Penal Code Section 422.55.”

    This would see to be a clear violationl.
