Everyday Injustice Podcast Episode 346: Father Challenges Son’s Federal Conviction

In Episode 346 of Everyday Injustice, host David Greenwald speaks with Joe Gandy, whose son, Jason Gandy, is incarcerated in federal prison following a conviction in the Southern District of Texas involving allegations of sexual exploitation. Gandy argues that his son was wrongfully convicted and that serious constitutional violations, questionable evidence and failures by defense attorneys and the courts prevented him from receiving a fair trial.

The case dates back to 2012, when Jason Gandy traveled from Houston to London during the Summer Olympics but was denied entry and returned to the United States. His father alleges that federal investigators questioned him for hours after he requested an attorney and subsequently used improperly obtained statements to build their case. He also raises concerns about motions to suppress evidence that he says remained unresolved for years, contributing to a lengthy delay before trial.

During the conversation, Joe Gandy challenges the prosecution’s interpretation of photographic evidence, disputes the credibility of testimony presented at trial and describes what he believes are significant inconsistencies in the government’s case. He discusses efforts to pursue additional post-conviction relief under 28 U.S.C. § 2255, including the involvement of experts who may examine interrogation practices and forensic evidence. These allegations represent the family’s account of the proceedings and have not been independently established in the interview.

The episode also examines the personal toll of prolonged incarceration on Jason Gandy and his family, including his father’s efforts to secure legal assistance and bring public attention to the case. Beyond the specific conviction, the discussion raises broader questions about access to counsel, judicial accountability, the handling of potentially exculpatory evidence and the obstacles incarcerated individuals face when seeking to challenge their convictions.
