Trial Ends in Light of Defendant’s Passing

In Department 13, the case against Eric Pape was dismissed by Judge Paul Richardson. Deputy Public Defender Martha Sequeira, representing the defense, and Deputy District Attorney Jay Linden, representing the prosecution, were both present. The defendant had been charged with the felony of battery with serious injury. In the previous reports from the Vanguard, Mr. Pape had been having a panic attack in the psychiatric hold at Sutter Health and a 28-year-old male nurse attempted to restrain him, resulting in a dislocated shoulder for the nurse. The incident had occurred on January 13, 2017, but the trial had been delayed several times. The defendant’s mother shared the delays were “part of the pressure” on her son.
The trial, which had been scheduled for the upcoming Monday, was dismissed due to the defendant’s passing two weeks ago.
Defendant from Rizo Trial Potentially Involved in Another Case

Adrianna Pena, a witness from the Rizo trial, had a review in Department 14. Judge Stephen Mock presided. Attorney Ava Landers represented Ms. Pena. Deputy District Attorney Jay Linden represented the prosecution. In her appearance in court, Ms. Landers requested that Ms. Pena be allowed on supervised OR with a GPS tracking unit, which the court had denied before. Judge Mock stood by the court’s previous ruling. Ms. Pena is expected to be arraigned later this week. She may be involved in another proceeding, an attempted murder case concerning police officers. Meanwhile, Ms. Landers noted that Ms. Pena will continue to cooperate while in custody.
