Davis Shooting Case Defendant Changes Attorneys, Confirms Preliminary Date

The case of Hayley Katherine Gilligan continues to unfold. With the plea now entered for the court, a preliminary hearing has been set for the charge of first-degree murder with an enhancement of personally discharging a firearm.

On Saturday, October 20, 2018, Hayley Gilligan, 29, was arrested for fatally shooting Jamie Kinseth, 35, at her home. Davis police would arrive afterward at her home, informed that a male subject had been shot. Ms. Gilligan would be taken into custody soon after.

Attorney Mark Reichel, Ms. Gilligan’s original attorney, stated that the defendant had acted in self-defense. Mr. Kinseth was claimed to have been threatening her weeks prior to the incident.

When he had forced himself into her home and refused to leave, Ms. Gilligan threatened to call the police. Previously, she had never called the police on him. The defendant went upstairs for the gun and her cellphone before having a “stand-off” for an hour. Mr. Reichel claimed the defendant saw Mr. Kinseth stand with something in his hand. She then shot him. Prior to the altercation, she had been texting her family, as they had planned to go to Disneyland for five days, and she provided these receipts to the court. Ms. Gilligan followed up with the text stating she shot Mr. Kinseth.

When the case returned to Department 1, Ms. Gilligan requested to switch attorneys.

Deputy Public Defender Joseph Gocke now represents her. Following the appointment of new counsel, she entered a not guilty plea to the counts against her. Judge Sonia Cortés set a preliminary hearing with no time waiver. This is set for December 3 in Department 13 with Judge Paul K. Richardson. Ms. Gilligan, meanwhile, currently remains in custody without bail.
